Biography

Marc de Monsembernard joined the firm in 2005 and has been co-head of the Public Law Department since 2007. He advises and represents his clients in the area of public property law (public and private property of public law entities) and the law of obligations (contract law, incl. contractual and non-contractual liability), in the area of spatial planning and in environmental law, as well as in matters relating to the sectoral regulation of network industries (energy, railways, electronic communications and postal activities), the regulation of economic activities and infrastructure construction, in particular for the benefit of public and private operators in the transport sector. He represents his clients before all administrative courts as well as before the dispute resolution and sanction bodies of the regulatory authorities and the Paris Court of Appeal.

Before entering the legal profession, Marc de Monsembernard worked as an administrative judge and legal director of a regulatory authority (the Energy Regulatory Commission, la Commission de régulation de l’énergie).

Marc de Monsembernard has taught public law at Sciences Po Paris since 1997, currently at the Faculty of Law. He has written numerous articles in public law journals. He is the author of several sections of the renowned Dalloz work on administrative procedural law (Répertoire Dalloz de contentieux administratif), dealing in particular with public contracts, administrative summary proceedings and administrative disputes concerning acts of sports federations. He is the author of Contentieux de la commande publique (Public Procurement Litigation), published by Dalloz in 2019.

In addition, Marc de Monsembernard is a mediator certified by the ESCP (École Supérieure de Commerce de Paris – Paris post-graduate business school) and the CMAP (Centre de Médiation et d’Arbitrage de Paris – Paris mediation and arbitration centre) and has multidisciplinary knowledge of inter-company conflict management
