IT Law & Intellectual Property Law

With experienced lawyers and a unique multidisciplinary practice in IT law and intellectual property law, our IT Law & Intellectual Property Team advises and represents its clients throughout the life cycles of their intangible assets.

Our team has in-depth knowledge of intellectual property, IT and data protection law, on which we offer our clients, together with other experts, innovative and highly personalised solutions to support and develop their activities.

IT and data protection law

Data protection law

Our team answers all questions on Big Data, Open Data, Connected Objects, personal data (especially health data) and non-personal data. We also support you in complying with all relevant legislation (GDPR, NIS Directive, e-privacy, etc.) as well as all relevant international instruments (BCR, Privacy Shield, Standard Contractual Clauses, Codes of Conduct and certifications), being able to incorporate the respective national law thanks to our international network of specialised lawyers around the world.

IT and technology projects

We set up and negotiate IT projects, integration, licensing, maintenance and cloud contracts (SaaS, PaaS and IaaS) as well as all other types of complex contracts. We also support publishers or users of mobile or web apps.

Cyberspace law
Our lawyers ensure the cybersecurity of your structures/tools by carrying out regular audits of the security measures put in place to protect against a possible cyber-attack. They fight against cybercrime (cyber attacks on automated data processing systems, data theft, phishing, cyber robbery, bug bounty, etc.) and assist you before the administrative authorities (e.g. the French data protection authority, the CNIL) and the competent courts, as well as before the specialised French police authorities (BEFTI, BRDA, etc.), in particular for the purpose of identifying the perpetrator behind the cyber attack. We also act vis-à-vis insurers in negotiating or claiming insurance cover (cyber risk) in the event of cyber damage.
Media and e-commerce law

Our lawyers take care of all questions regarding media and e-commerce law:

  • Websites and marketplaces (wording of the GTC, imprint, legal notices, data protection provisions, cookie banners);
  • Online commerce and mobile commerce, responsibility for online content (information according to the French IT law (Loi pour la confiance dans l’économie numérique), editorial responsibility/hosting companies, ISP, social networks);
  • Right to be forgotten and online reputation management (privacy, image rights, disparagement, online press offences);
  • Online games;
  • Protection of the confidentiality of communications.

Intellectual property

Industrial property protection

Our lawyers help you protect and enhance the value of your innovations, industrial creations and any kind of inventions from the very beginning: They accompany you from the development of a protection strategy and the filing (prior art searches, filing/registration of trademarks/company names/domain names/designs and models/patents), to the exploitation (advice on contracts and carrying out due diligences, in particular in the context of investments) and finally in the context of the defence of your rights (counterfeiting, unfair competition and parasitism) before the courts and the competent French and European offices (INPI, EUIPO, WIPO, EPO, AFNIC and other registrars).

Copyright and related rights
Our fields of activity are diverse. They include first the development of a protection strategy (deposit of source codes, acquisition/verification of the chain of rights for works of all kinds, e.g. literary, musical and graphic works), then exploitation (e.g. drafting/negotiating contracts or interaction with collecting societies), finally defence (counterfeiting, unfair competition, parasitism, infringement of know-how and trade secrets). This applies to all types of works: software, databases, literary/artistic/musical works and creative works created with artificial intelligence algorithms (machine learning, deep learning, etc.).
Know-how and trade secrets
On the one hand, we intervene preventively by preparing agreements and/or filing for legal protection and verifying the actual confidentiality of the information to be protected (analysis of IS, initiation of technical, organisational and legal measures). On the other hand, we assist you in defending or asserting your rights by appearing before the civil and criminal courts in the event of a breach of know-how or trade secrets.
