A multidisciplinary team
When our expertise is required, our lawyers form multidisciplinary teams to advise and assist operators or stakeholders in the context of major industrial projects (industrial zones and special economic zones) or major infrastructure projects (in particular motorways, roads, dams, bridges, stadiums and sports arenas) in the negotiation and/or execution of concession, construction or project planning agreements.
Comprehensive expertise
Our lawyers are familiar with the (model) contracts of the International Federation of Consulting Engineers (FIDIC), which are widely used in international construction projects, as well as with national laws and regulations, having participated in the drafting of several codes on public procurement law, including in particular the codes of Côte d’Ivoire and Gabon, as well as their implementing texts, such as. e.g. the Cahier des Clauses et Conditions Générales (CCCG) applicable to public works contracts in the Republic of Côte d’Ivoire.
Our lawyers have extensive practical experience with administrative contracts in mainland France, the overseas departments or French-speaking Africa, public works or project planning contracts, and public-private partnerships (PPPs) set up to implement such major infrastructure projects.
Our lawyers specialising in the construction industry and its players have a recognised experience of more than thirty years in the field of construction. Together with our international lawyers, they form a multidisciplinary practice group to advise and assist operators or stakeholders of major projects, including certain states or public entities in West or Central Africa. If necessary, we can also recommend competent technicians who will carefully and promptly deal with the problems that have arisen.
At the client’s request, the multidisciplinary practice group can act both in asserting and enforcing claims and in obtaining bids or until the expiry of various guarantee periods of the project.
dispute management
In the event of a dispute, in particular when a case is referred to arbitration, e.g. under the ICC Arbitration Rules, our lawyers manage all aspects of the proceedings and participate in the preparation of the experts for cross-examination.
The multidisciplinary team ensures continuous monitoring of the planned project, reports regularly to the client on its actions and carries out a periodic assessment of the economic, legal and technical risks.
