Litigation

Our firm has developed a litigation practice in all areas of commercial law and has recognised expertise in complex litigation representing private and public companies, particularly in an international context.

This expertise, combined with an in-depth knowledge of our clients’ businesses and areas of activity, enables klein • wenner to efficiently manage litigation at all stages of proceedings: from developing a litigation strategy, gathering and searching for evidence, assessing the risks and amount of claims, to conducting protective or enforcement proceedings, in order to quickly achieve the objectives that are in line with our clients’ interests.

Civil litigation

The firm has a proven practice in complex litigation and summary proceedings and a recognised expertise in procedural law. In this respect, our teams intervene in main proceedings or in proceedings concerning interim relief before all courts (the commercial courts, the civil courts of first instance (tribunaux judiciaires), courts of appeal (cours d’appel) and, with the assistance of specialised lawyers, the Supreme Court (Cour de cassation)). Our teams know how to deal with procedural arguments and use the most appropriate procedures (e.g. extreme expedited procedures, such as référés à heure indiquée and expedited procedures, jours fixes and brefs délais) to obtain decisions within a few months or even weeks.

Public litigation

The firm represents clients before the administrative courts, the administrative courts of appeal and, together with specialised lawyers, before the Supreme Administrative Court (Conseil d’État). Our teams also assist our clients in proceedings before the so-called “Independent Administrative Authorities”, such as the French data protection authority, the CNIL.

Employment litigation

Our employment law teams represent our clients’ interests from the receipt of an employee’s claim to the decision before an employment tribunal or appeal court in France. As part of this support, we define a strategy tailored to the dispute in order to prevent the risks involved, assess the level of risk of conviction following an in-depth analysis of the facts, and then accompany our clients throughout all stages of the proceedings.

Commercial criminal litigation

A special feature of French law is that legal entities can also be prosecuted. Our team often acts in cases of “classic” corporate offences (misappropriation of corporate assets (abus des biens sociaux), embezzlement, fraud, abus de confiance, CEO fraud, or the like), but also and above all in all matters related to the criminal aspects of day-to-day business: Work accidents, violation of environmental or labour regulations, violation of intellectual property rights or trade secrets, insider trading, corruption, etc.

Sports litigation

Sports law proceedings are quite broad. On the one hand, there are special sports law disputes and, on the other hand, general disputes.
General litigation is handled by the different departments of the firm according to their areas of expertise. The aim is, for example, to protect the intangible rights of associations, to support them in labour law, to monitor their general litigation or to assist them in drafting contracts.

Sports law disputes can be of a private or public law nature. For example, the firm’s public law team conducts proceedings before the Administrative Court, the Superior Administrative Court (Conseil d’État) or, for example, the French Olympic Committee (CNOSF).
